All of stream LFC-2 below the ordinary high water mark was U.S. Waters and under the jurisdiction of the U.S. Army Corps. of Engineers and section 404 of the Clean Water Act. In addition, the upper portion of the project was identified to be wetlands. The project design consisted of a combination of avoidance and mitigation along with the engineering solutions required to meet the client objectives within the regulatory guidelines.
